WashingtonCountyAttorneysOffice2013AnnualReport3MessagefromtheCountyAttorney.WelcometotheWashingtonCountyAttorneysoffice2013annualreport.IthankyouforyourinterestinmyofficesworkandIamconfidentthattheachievementsofmyofficesattorneysandstaffwillimpressyouasmuchastheyhaveme.ThisreportmarksthecompletionofmythirdyearservingasCountyAttorney.AlongwithourpartnersinlawsenforcementandcommunitiesthroughoutWashingtonCountytheCountyAttorneysofficehasaccomplishedagreatdealin2013toenhancepublicsafety.Asyouwillseeinourofficeshighlightswehavedonemuchtoenhanceoureffectivenessastrialattorneyswithourmonthlyin-housetrialskillstrainingaswellasourquarterlytrainingforlawenforcementofficers.Atthesametimewehavecontinuedtodevelopproactivecrimepreventioninitiativesandcitizeneducationprogramstoaddressfactorsthatdrivecrimeinourcommunities.Acrosstheorganizationtherearestoriesofsuccessandstandoutemployeeswhohelpmakeusoneofthepremiercountyattorneyofficesinthestate.Ourrecordofeffectivelyholdingoffenderstoaccountincourthasresultedinanumberofhighprofilejurytrialsincludingasuccessfulprosecutionofafirstdegreemurdereraswellassixotherhomicideprosecutionssuchasdistributingnarcoticsresultingindeathtotheuser.Iamproudofthefactthatforthethirdyearinarowthisofficehasquadrupledthenumberoftrialsascomparedtopreviouslyresultinginmoreeffectivejusticeforvictimsandcitizens.Wealsohaveemployedawidevarietyoftoolstofightcrimeandenhancesafetyusingdiversionaryandtreatmentprogramssuchasourveteransprogramoffenderrecoveryprogramfordrugaddictedrecidiviststruancyandsafeschoolsinitiativesandrestorativejusticeprogramsforcrimevictims.Thesestrategiesalongwithaggressiveprosecutionshavebeenshowntobeeffectiveinshortcircuitingthecriminalcareersofoffendersmuchearlierandgettingoffendersoutofthesystempermanently.Iammostproudperhapsofmyofficesdeliveringthehighestqualitylegalservicesforourcitizensusingsoundfiscalmanagementwhichhasallowedustoprovidepublicsafetyandcivillegalservicesunderbudgeteachyearsincetakingofficein2011.PeteOrput WashingtonCountyAorneysOfce2013AnnualReport4AdministrativeDivisionTheFirstAssistantrunstheadministrativedivisionwhoseprimaryfunctionistosupporteveryotherdivisionandensurethesmoothoperationoftheoffice.Thedivisionperformsafullrangeofsupportservicesincludingcommunityoutreachhiringattorneysandstaffpreparationandoversightofthebudgetandfiscalmattersprovidinginformationsystemsservicespurchasingfacilitiesmanagementmediarelationsgrantandprogramoversightandspecialprojects.Theadministrativestaffmustworkcloselywithalldivisionstoensurecompliancewithandimplementationofallpoliciesstandardsandmandatesoftheoffice.AdministrativeServicesManagerBarbaraNelsonisresponsiblefortheeffectivemanagementofour4.8millionannualbudgetsupportservicesmattersandtechnologicalresourcesandinitiatives.Sheisalsoresponsibleformaintainingourelectroniccasemanagementsystemusedtofacilitatetheworkflowandworkproductsmaintainedineachfunctionaldivisionandwiththeassistanceofasupervisorsheisresponsibleformanagementofdivisionclericalstaffconsistingof11legalassistants3paralegalsandanofficesupportposition.Administrativedivisioninitiativesin2013includeSafetyandSecurityAsecurityauditoftheofficeidentifiedaneedforavisitorbadgedevicethatwillidentifynon-policeofficerandnon-countystaffvisitorsthatfromtimetotimewefindinouroffice.InMarchweobtainedourvisitorbadgeequipmentandrequiredallvisitorstotheofficetocheckinshowidentificationandhavedisplayedavisitorbadge.Thisisonesmallefforttowardassuagingstaffsafetyconcerns.WecontinuetoworkwithCountyAdministrationtoimplementothersafetyandsecuritymeasuresforouremployees.HistoryoftheOfficeInrecognitionoftherichheritageinWashingtonCountyinAprilourofficebegantocollecthistoricalphotographsinordertohangonthewalltoenhancetheofficeenvironmentanddisplayforthepublic.AspartofthisprojectstaffobtainedfordisplayportraitsofalloftheCountyAttorneysthathaveservedforWashingtonCountysincethecountycametoexistence.Thedisplayincludesthenamesanddatesofservice.TrainingRoomInJulytheofficeuseddrugforfeiturefundstoupdatethetrainingroomtoincludeanewoverheadprojectordropdownscreenandoverflowroomwhichallowsustoputonCLEandPOSTcertifiedlegaltrainingopportunitiesforourstaffcityprosecutorsandlawenforcementpartners.BrentWartnerFirstAssistantCountyAttorneyBarbaraNelsonAdministrativeServicesManager WashingtonCountyAorneysOfce2013AnnualReport6CivilDivisionWedeliverhighqualitylegalrepresentaonwithbudgetarydisciplinewhilemaintainingsuccessfulclientrelaonships.Thedutiesofthecivildivisionrangefromcraftingcontractstorenderinglegalopinionstoactingascountyboardparliamentariantorepresentingthecountysinterestsincourt.Becauseitsresponsibilitieswithinthecountyaresopervasivethecivildivisiontouchesnearlyeverydepartmentinthecounty.Withthisinmindthecivildivisionlooksforwayswhichwillhelpdepartmentsexpediteitsworkwithinalegalframework.Inthatrespect2013sawthecivildivisionbuildupontheseveralinitiativesitinstitutedwithdepartmentsin2012whilealsoestablishingnewonesin2013.Themostnotableoftheinitiativesfor2013andoneverywelcomedbythedepartmentsinvolvedtakingonthetaskofbeingtheclearinghousefordatarequeststodepartmentsundertheMinnesotaDataPracticesAct.Aprotocolwasestablishedwherebyifarequestfordataismadetoaparticularcountydepartmenttherequestorforwardedtothecivildivisionwhichinturnwouldworkwiththedepartmenttogatherthedatadeterminetheclassificationofthedataandthenprovidetherequestedpublicdatatotherequestor.Indevelopingourinitiativesoneofourpivotalconsiderationsisarecognitionthatthecountyseffortsincollectingmoniesoweditwasoftenstymiedbyalackofaccesstothelegalprocess.ToaddressthisweformedallianceswithCommunityServicesandtheAccountingandFinanceDepartmentwherebyanattorneyisspecificallyassignedtoworkwithbothdepartmentsinthecollectionprocess.Theresultisthatbothdepartmentsrealizedasignificantgainincollectionsfor2013.ForexampleCommunityServicescollectedover206000inmedicalassistancereimbursementsthroughtheeffortsoftheattorneyassignedtoit.GeorgeKuprianCivilDivisionChiefWashingtonCountyAttorneysofficehonoredveteransandfamilymemberspicturedVickyKrawczeskiGeorgeKuprian WashingtonCountyAttorneysOffice2013AnnualReport7CivilDivisionAnotherofthemoreimportantdutiesassignedthecivildivisionisthepursuitofchildsupportpaymentsthroughdistrictcourtactions.Althoughitlackstherenownofothertypesofcasesithasanimpactinaverybigwayonsomeofourmostvulnerablepeoplechildrenandsingleparents.ThereforethecivildivisiontakesprideinthefactthatinpartnershipwithCommunityServicesWashingtonCountycontinuestooutpacethestateaverageinrealizingchildsupportcollections.Weareoneoftheleadingcountiesinthestateincollectingchildsupportpayments.ThecivildivisiontakesgreatsatisfactioninthefactthatitisapercapitaleaderintheStateinlitigatingpropertytaxappeals.Thedecisiontolitigatethesecasesisfoundedonabeliefoffairnessintaxationandabeliefintheabilitiesofthecountyassessorstorenderafairandproperassessment.Inadditiontoitsmyriadofotherdutiesthecivildivisionisalsothecountyslitigatorand2013itdefendedthecountyinalawsuitthatmayhaveramificationsfornearlyeverycountyinthestate.Thesuitispredicatedinthesheriffsabilitytochargeajailfeeandinthemannerinwhichitiscollectedwhichtheplaintiffclaimsisdoneinanillegalandunconstitutionalmanner.Theplaintiffalsoseeksclasscertificationsoalthoughthedirectdamagesaresmallabout25theconsequentialdamagesparticularlyattorneysfeesmayprovelarge.Thecaseisinitsinfancybutweareconfidentofprevailing.Thecivildivisionalsopioneeredtheofficestransitiontoe-filingelectronicfilingofdocumentsbycomputer.Althoughtherewereafewbumpsalongthewayitsimplementationwasnearlyseamless.InfactthesupportstaffexhibitedsuchsavvyinitsimplementationthatitwascalleduponbyCommunityServicesinitstransitiontoe-filing.CivilDivisionChiefGeorgeKuprianAttorneysRickHodsdonMikeHutchinsonLindaKraftheferMauraShuttleworthSueSteffenTiceJimZulegerParalegalsDebPetersonNancyTavernierCharTrendeLegalAssistantsVickyKrawczeskiAllisonCossettaSandieLarsen WashingtonCountyAorneysOfce2013AnnualReport10CriminalDivisionAggressiveprosecuonisthekeytoprotecngpublicsafety.Thecriminaldivisionconsistsofthedivisionchiefandseven7assistantcountyattorneysresponsiblefortheprosecutionofallfeloniescommittedinthecountyaswellasmisdemeanorscommittedinselectedmunicipalities.Thedivisionalsoconsistsoffour4victimwitnessadvocateswhosedutiesincludeactingasvictimliaisonsthroughoutcriminalcases.Theyalsomarshalwitnessesfortrialfortheprosecutingattorneyshandlingthecases.Theadvocatesmissionistoimprovethequalityofjusticeforvictimsandthecommunitybyprovidingsupportiveandinformativeadvocacy.Wecontinuetoimplementthechangesinphilosophyandmannerinwhichcaseshavebeenhandled.Thiscanbebrokendownintothree3majorareaschargingcaseemphasisandpleaagreementstrials.Themethodologywehaveimplementedfacilitatesatimelydecision-makingprocessonrequestsforcharges.Attorneysarerequiredtomakeadecisiontochargedeclineacaseorreferacaseforfurtherinvestigationinanexpeditedmanner.Tothatendbytheendof2013theaveragetimebetweenacasefileenteringtheofficesystemandachargingdecliningreferringdecisionbeingmadewasdowntosix6days.Ourconstituenciesarenowbeingmuchmoreefficientlyservedwithtimelychargingdecisions.Inturntimelychargingdecisionsbetterinsureviablelong-termcriminalprosecutions.Inallthepublicandparticularlyvictimsofcrimearemuchbetterservedasaresultofthisaccomplishment.Thecriminaldivisionhasfocusedonviolentoffensescareeroffendershumantraffickingandcomplexprosecutionsnottotheexclusionofotheroffenses.Howeverwhenallocatingresourceswebelievethatthepublicisbestservedwiththerealizationthatcriminaljusticeattentionshouldbestbefocusedontheseareas.Consequentlythishasledtochangesinhowwehavedealtwithcaseswithinthesystem.Weoperateunderaverticalsystemofprosecution.Thismeansthattheprosecutorthatchargesthecasewillhandlethecaseallthewaythroughtrial.Thisinsuresaconsistencyofhandlingthatcasethroughout.Coupledwiththatisamethodologywherewehaveemphasizednegotiatingwiththedefenseoncasesotherthanthecomplexcareerandviolentoffenseswellinadvanceoftrialsoourprosecutorscouldfocustheirpreparationsoncasesthataregoingtobepresentedtoajury.FredFinkCriminalDivisionChief WashingtonCountyAttorneysOffice2013AnnualReport11CriminalDivisionThosecasesthatdoreachthejurycalendarareeithertriedtoajuryorthedefendantmustenterastraightguiltypleawithnoagreementastosentencing.FocusingaswehaveonviolentcareerandcomplexcasesandproperlypreparingthemwehavequadrupledX4ourtrialsoverthepastthreeyearsinoureffortstobringahigherqualityofjusticetoWashingtonCountyresidents.In2013thecriminaldivisiontriedtwenty-five25casesandwereintrialonehundredfive105days.Thiswasinexcessof40ofthedaysavailableforcriminaltrialsin2013.Lastyearaloneourofficewasinvolvedwithseven7separatehomicidecases.Thedivisionhasalsobecomeheavilyinvolvedinwhatiscalledtheinvestigativephaseofprosecution.Putanotherwayourprosecutorsoncertaintypesofcasesdonotwaitforthefinishedinvestigativeproducttoarriveintheoffice.Rathertheyareinvolvedinassistinginvestigatorsintheinvestigativephasebetterassuringasolidcaseforprosecution.TypicalexamplesofthisarewhenaprosecutorgetscalledtothesceneofahomicideorarsonorwhentheymeetonaweeklybasiswiththeNarcoticsTaskForcetoreviewongoingcriminalenterprisecases.Aprosecutorfromourofficealsoisheavilyinvolvedintheinvestigativephaseonourhumantraffickingcasesconferringwithlawenforcementduringtheinvestigationallthewayuptochargingandthroughouttheprosecution.Ourofficeenjoysafavorablereputationamongothercountyattorneysoffices.Assuchwewereaskedtoanddidhandleeleven11conflictofinterestcasesforothercountyattorneysofficesin2013.RamseyAnokaHennepinIsantiandChisagocountiessoughtourassistancewhentheseissuesaroseandwewereabletoaccommodatethem.Converselywearethenabletocalluponthemshouldweeverhaveacasewhereaconflictarises.CriminalDivisionChiefFredFinkAttorneysImranAliPeteJohnsonKarinMcCarthyJessicaStottTomWedesRobinWolpertSivYurichukSupervisorTeriKellyLegalAssistantsPamHughesAlissaLeibfriedJeanMerschTheresaRedmanEricaSullivanAlyWojcikVictimWitnessCoordinatorsSteveDespiegelaereDebSmithChristineVonDeLindeMaryWaldkirch WashingtonCountyAorneysOfce2013AnnualReport14JuvenileDivisionWerecognizethateecvejuvenileprosecuongoesbeyondthecourtroomandinvolvesjuvenileoutreachandtheprevenonofjuvenilecrime.ThejuveniledivisionledbydivisionchiefTonyZdroikprosecutesalljuveniledelinquencycasesfiledinWashingtonCountyCourt.Thejuveniledivisionseekstopromotepublicsafetythroughtheprosecutionofjuvenilecrimeswhiletakingintoconsiderationthespecialcircumstancesofjuvenileoffenders.ThejuveniledivisionalsoprovideslegalrepresentationtoWashingtonCountyCommunityServicesonchildprotectionmattersthatinvolvechildrenwhohavebeenabusedorneglectedbyaparentorlegalcustodian.Thechildprotectioncaseloadwassignificantin2013forthejuveniledivision.Thedivisionreceived81referralsregardingchildprotectioncases.Thatnumberwasa20percentincreasecomparedto2012andthemostreferralssince2005.Amongthosereferralsthedivisionalsoreviewedandfiled22TerminationofParentalRightsorotherpermanencypetitionsin2013.ThechildprotectionnumbersaresignificantbecausethosecasesareoftenamongthemostcomplexandtimeconsumingcaseshandledbytheCountyAttorneysoffice.TheCountyAttorneysofficehasmadeitaprioritytotrainandcommunicatewithlawenforcementontheinvestigationofcriminalcasesoverthelastfewyears.Thatcommunicationispayingoffasseeninthelownumberofcasedeclinationletters.Thenumberofcasesdeclinedforprosecutionreachedanastoundinglowof73casesin2013.Bycomparisontheaveragenumberofcasedeclinedforprosecutionoverthelasttenyearshasbeen181casesperyearwithahighof283in2008.Inordertopromotepublicsafetythisofficeholdsjuvenileoffendersaccountableforallseriousoffensesbyaskingthecourttocertifyajuveniletostandtrialasanadult.Forexamplethejuveniledivisionaggressivelyprosecuteda16yearoldwhoburglarizedmultiplehomesthispastyearinCottageGrove.Duringoneburglarythejuvenilethreatenedahomeownerwithaknife.Lawenforcementworkeddiligentlytoinvestigatethecasesandthejuvenileultimatelypledguiltytothreeburglariesandarobbery.Heisawaitingsentencing.TonyZdroikJuvenileDivisionChief WashingtonCountyAttorneysOffice2013AnnualReport15JuvenileDivisionYouthOutreachCrimePreventionInadditiontothecommitmenttoeffectivelyprosecutejuvenilecrimestheWashingtonCountyAttorneysofficealsorecognizestheneedforprosecutingagenciestohavearoleincrimeprevention.InaccordancewiththattheCountyAttorneysofficefurtherrecognizesthatanessentialelementofcrimepreventionforjuvenilesisschoolattendance.In2013theCountyAttorneysofficecontinueditseffortsaroundatruancyinitiativethatbegantheprioryear.TheoverallgoalofthetruancyinitiativeistopromoteregularschoolattendanceandhighschoolgraduationforWashingtonCountystudents.Asignificantpartofthatismeetingthestudentsfacetofacetoinformthemabouttheissuesandconsequencesofcontinuedtruancy.Thisisdoneintwoways.FirststudentsandparentsareinvitedtoanAttendanceInterventionMeetingAIMwheretheyareinformedoflegalrequirementsofschoolattendancetheconsequencesfortruancyandwhatoccursifthechildcontinuestomissschool.SecondifthestudentcontinuestomissschoolaftertheAIMmeetingadiversioncontractmeetingisscheduled.Atthatmeetingthestudentandparentmeetwithanassistantcountyattorneysocialworkerandschoolofficial.Thepartiesdiscussthestudentsattendanceissuesandenterintoacontracttopromoteimprovedschoolattendance.Duringthe2012-2013andsofarduringthe2013-2014schoolyearapproximately250familieshaveattendedtheAIMmeeting.DuringthatsameperiodoftimetheCountyAttorneysofficehasscheduledmeetingsonDiversionContractsforover125families.Theseinterventionshaveresolvedmanyschoolattendanceissuesforstudentsandparentswithouttheneedforjuvenilecourtintervention.JuvenileDivisionChiefTonyZdroikAttorneysRickAllenSueHarrisErinJohnsonKariLindstromKevinMuellerLegalAssistantsSherryHillmanTeriSeldenDeclineinNeedforTruancyPetitions0204060201020112012201337425320 WashingtonCountyAorneysOfce2013AnnualReport16JuvenileDivisionInordertofurtherreachouttostudentstheCountyAttorneysofficehasdevelopedpresentationsonissuesrelevanttostudents.In2013theJuvenileDivisionmadepresentationsaboutbullyingandcyberbullyingontwooccasions.FirstdivisionchiefTonyZdroikparticipatedinapanelonbullyingwhichdiscussedtheissueswiththeentirefreshmanclassofWoodburyHighSchool.Mr.ZdroikmadeasecondpresentationaboutthepublicsafetyimpactofbullyingandwhatstudentscandotorespondtoittothestudentbodyofNorthSt.PaulHighSchool.Thetwopresentationsreachedover2500students.TheCountyAttorneysofficefurtherrecognizesthatinterventionsaremosteffectiveforjuvenileswhentheyreceiveservicessoonaftertheoffenseandwithintheirowncommunity.Thisdecreasesthelikelihoodofadditionaloffensesforthatjuvenile.InfurtheranceofthatideatheCountyAttorneysofficescreensallcasesforparticipationinadiversionprogram.InWashingtonCountyifajuvenileissenttoadiversionprogramheorshereceivesservicestoaddresstheoffenseatoneoftheYouthServiceBureauslocatedinForestLakeWoodburyStillwaterorCottageGrove.Thejuvenileisheldaccountablefortheoffenseandrequiredtoparticipateinservicesthroughcontract.In2013theCountyAttorneysofficedivertedone-thirdofallchargeablecasestoaYouthServiceBureau.PledgetoGraduateDrawingsTheWashingtonCountyAttorneysOfficehasplacedahighpriorityonschoolattendanceeducationandgraduationforallstudentslivingintheCounty.WashingtonCountyhasathreelevelTruancyProgramthatinvolvesaddressingpoorschoolattendance.Emphasisisalsoplacedonrewardingthosestudentswhomakeacommitmenttograduatewiththeirclassandreceiveahighschooldiploma.ForthesecondyearinarowtheWashingtonCountyAttorneysOfficehasheldadrawingattheCountyFairforstudentsK-12whomakethispledge.TwoluckystudentseitherwinaclassringdonatedbyJostensoraniPaddonatedbySamsClub.ThewinningstudentswillbeawardedtheirprizeinFebruary.2013PledgetoGraduateWinnersStudentatWoodburyMiddleSchoolawardediPaddonatedbySamsClubStudentatStillwaterAreaHighSchoolawardedclassringdonatedbyJostens WashingtonCountyAorneysOfce2013AnnualReport18GunViolenceDespitetheoveralldeclineinthenumberofgunhomicidesoverthelast15yearsgunviolenceinAmericaremainsextraordinarilyhigh.Two-thirdsofthe15000peoplemurderedeachyeardieatthehandofarmedcriminals.Useofagungreatlyincreasesthelikelihoodthataviolentcrimewillbecompletedparticularlyincasesofrobberyandrape.Wehaverespondedtothisepidemicbyfocusingonpartnershipsbetweenalllawenforcementagenciescommunityoutreachandvigorousprosecutionofguncrimes.Violentcrimeisasocialproblem.Nooneexpectsanyscientificbreakthroughtoremedyit.Inordertosolvethisproblemoreventoattempttoithastocomefromchangingattitudesandbehaviorsofvariousgroupsandindividualsbothinsideandoutsidethecriminaljusticesystem.Hencetheneedforthepartnershipswehavebeguntoformulate.Indirectresponsetogunviolenceandviolentcrimeourofficefocusesourallocationofresourcesinprosecutingthesetypesofcasesandmaintainsahardlineinsettlementdiscussions.Victimsofthesecrimesandtheoverallsafetyofthepublicdeservenothingless.HumanExploitationTraffickingSextraffickingoccurswhenpeopleareforcedorcoercedintoprostitutionagainsttheirwill.Sextraffickersatoopolitetermtodescribepimpsfrequentlytargetvulnerablepeoplewithhistoriesofabuseandthenuseviolencethreatsliesfalsepromisesdebtbondageorotherformsofcontrolandmanipulationtokeepvictimsinvolvedinprostitution.Sextraffickingexistsoftenatmuchlargerratesthanmostpeoplerealizeandhasbeenfoundinawidevarietyofvenuesincludingresidentialbrothelshotelsonlineescortservicesfakemassagebusinessesandstreetprostitution.IndeedsextraffickingismuchclosertohomethanyouthinkvictimsyoungerthaneverarejustaslikelytobethehomegrownAmericangirlnextdoorasillegallyimportedforeignersbutthetragicresultisalwaysthesame-victimsaregenerallyforcedtoworkfororprovideservicestothetraffickerorothersandtheyareoftenheldagainsttheirwillthroughactsofcoercion.Thisofficeinpartnershipwithourlawenforcementpartnersarecommittedtoprosecutingthosepimpsandcustomersofsextraffickerstothefullestextent.Ourjuvenileprosecutionunitisalsocommittedtomakingeffortstogethelpforthosevictimsensnaredinthewebofexploitation.LastyearworkingcloselywithRamseyCountyAttorneyJohnChoiwesuccessfullypersuadedourlegislaturetotreatjuvenilesinvolvedinsextraffickingasvictimsandnotdelinquents.Thiswasaneededfirststepinhelpingadolescentgirlsescapetheclutchesofthepimpsandjohnswhoexploitthem.Ourjuvenileandadultprosecutionteamsworkjointlyinassuringthatthosebeingexploitedgetthehelpthatisavailablewhilestronglyenforcingourcriminallawsagainstsextraffickinginourcommunities.In2013ourofficeprosecutedprostitutionsextraffickingcasessuchasacasewhereweworkedwithsocialserviceagenciestorescueanadolescentgirlfromthepernicioussexualexploitationtrade. WashingtonCountyAttorneysOffice2013AnnualReport19HighProfileCasesMurderCasesThomasFox-convictedbyajuryofFirstDegreePremeditatedMurderintheknifekillingofanOakdalewoman.Sentencedtolifeinprisonwithoutpossibilityofrelease.DemetriusBallinger-convictedofAttemptedSecondDegreeIntentionalMurderandfour4countsofFirstDegreeCriminalSexualConduct.Rapedfour4juvenilegirlsatgunpointandshotatayoungmanwhotriedtogetawayattheRedRoofInninWoodbury.Sentencedto36yearsinprison.MathewDavidFeeney-convictedofSecondDegreeCriminalSexualConductandFourthDegreeCriminalSexualConduct.Feeneyranatalentagencyandusedhispositiontogetclosetoandsexuallymolesttwojuvenilemales.Sentencedto109monthsinprison.EmilyKatherineJeanFryeconvictedofThirdDegreeMurderforprovidingcontrolledsubstancestothevictimcausinghisdeath.Sentencingtobeheldin2014.NhanLapTran-chargedwithMurderintheSecondDegreeintheshootingdeathofa9yearoldboyinOakdale.Tranwasfoundincompetenttostandtrialandhasbeencivillycommitted.RapeCasesJohnathanRichardBeying-convictedofFirstDegreeCriminalSexualConductforsexuallyabusingafamilymember.Sentencedto187monthsinprison.JoshuaA.Olaosebikan-convictedbyajuryofFirstDegreeCriminalSexualConductinanacquaintancerapecase.Sentencedto144monthsinprisonChildAbuseCasePresidentPimpinAustin-convictedaftertrialofMaliciousPunishmentofaChildUnderFourCausingBodilyHarmandFelonyDomesticAssaultafterhetookacoaxialcableandwhippedhis2yearoldchildaboutthebacklegsandgenitalareawithit.Alsoassaultedthechildsmother.Sentencedto72monthsinprison.WeaponsCaseJeromeMisters-convictedbyajuryofFeloninPossessionofaPistolandAttemptedAggravatedRobberywithaHandgun.AlsofoundtobeaCareerCriminalforsentencingpurposesandwassentencedto120monthsinprison.TheftCaseDanielJohnCallinan-convictedofaseriesofburglariesandsentencedto38monthsinprison. WashingtonCountyAorneysOfce2013AnnualReport20ConsumerEnvironmentalVulnerableAdultProtectionThisofficeiscommittedtoprotectingthepublicfromthedangersoffraudandotherexploitationcrimes.Thebestprotectionispublicawarenessandthisofficeconductscommunityoutreachtoalertandinformcitizensaboutpotentialscamsswindlesandfrauds.Inparticularexploitationcrimesarefrequentlydirectedatvulnerableadultsbotholdandyoungwithdevastatingpersonalsufferingandeconomicconsequencesforthoseindividualslivingonafixedmonthlyincome.TopreventfinancialorotherexploitationfromhappeningweaggressivelyenforceMinnesotalawsrulesandpoliciesthatprotectvulnerableadultsandseekredressforvictims.InadditionwefostergoodrelationshipsandinitiativesacrossjurisdictionsandagenciesbybeingactivelyinvolvedintheEastMetroCrimePreventionCoalitionVulnerableAdultJusticeProjectandWorldElderAbuseAwarenessDay.Membersoftheseorganizationshaveashareddedicationtoimprovingsystemsandresourcestoprotectvulnerableadultsandbringpublicawarenesstothegrowingissue.Thecriminaldivisionoftheofficeaggressivelypursuesoffenderswhofinanciallyorphysicallyvictimizetheelderlyandvulnerable.Inoneexamplechargesarependingagainsttheadultdaughterofanelderlywomansufferingfromdementia.Thedaughtercashedoutmorethan54000inannuitiesinhermothersnameanddidnotusethemoneyforhermotherscareorneeds.Inanothercaseourofficefiledanemergencysubstituteguardianshippetitiontoallowpolicetoimmediatelyremoveadevelopmentallydelayedwomanfromthecareandcustodyofhermotherwhowasherlegalguardian.Hermotherwasallegedtohavebeentransportingthedaughtertodifferentlocationsandforcinghertoperformactsofprostitution.UltimatelythedaughterbecamepregnantandhermotherwasconvictedofNeglectofaVulnerableAdult.Ourofficecontinuestoworkonprotectiveproceedingsforthedaughterandherchild. WashingtonCountyAttorneysOffice2013AnnualReport21TrainingPoliceTrainingTheofficecontinuedin2013toprovideextensivetrainingtolocalpoliceagenciesandoursheriffsoffice.Aftersurveyinglawenforcementfortheirneedsweinstitutedquarterlypolicetraining.Thistypicallyinvolvedathreehourdayclassandthreehoureveningclassinordertomakethetrainingavailabletoallshiftsofpolice.Thetraininghasbecomeverypopularwithlawenforcement.TopicshaveincludedOverviewofAdmissibilityofWarrantlessSearchesandSeizurePracticalAdviceontheAdmissibilityofStatementstoPoliceInvestigativeLiabilityAwarenessOverviewofLegalIssuesforSchoolResourceOfficerSchoolAdministratorsThevalueofprovidingpolicetrainingtolawenforcementagenciescanbemeasuredinthequalityofthecasespresentedtoourofficeforprosecution.Additionallyitservestostrengthenourrelationshipswithallofthelawenforcementdepartmentsandtheirindividualofficers.Wehaveprovidedfifty-eight58hoursofpolicetrainingin2013toatotalofover400policeofficerattendees.Theseclasseshaveresultedinfewercasesbeingdeclinedforprosecutionduetoelementsofthecrimenotbeingabletobeproventostrongerandmoretargetedeffortsinprosecutionofviolentcrimesandtargetedcriminalprosecution.ProsecutorTrainingInadditiontoofferingregularlyscheduledlawenforcementtrainingthisofficeoffersprosecutortrainingbothin-officeandstatewide.Prosecutorsfromourofficehaveprovidedsixty-seven67hoursofprosecutortrainingin2013to438prosecutors.Onamonthlybasisourofficeprovidestechnicalprosecutortrainingtoourmunicipalprosecutorpartnersandourownlawyers.Oneofthesidebenefitsofholdingtrainingwithourmunicipalprosecutionpartnersisinthefosteringofcloserworkingrelationshipswiththem.Thiscommitmenttomakingtheprosecutionfunctionthebestitcanbeisreflectedinthefactthatthetrainingprovidedbyourofficewasallvolunteer.Theseeffortsintrainingwithlawenforcementprosecutorsothercountydepartmentsandthepublicwillcontinueastheycanonlybenefitthecriminaljusticesysteminthelongrun.
